On December 23rd, Judge Mary McElroy issued a written preliminary injunction in the Continuum of Care (CoC) lawsuits State of Washington et al. v HUD and National Alliance to End Homelessness et al. v HUD. The injunction goes further than the verbal ruling given the previous week.
The court’s order effectively reinstates the FY 2024-2025 Notice of Funding Opportunity (NOFO) for the Continuum of Care (CoC), prohibits the enforcement or release of any other NOFO for FY 2025 funds, and instructs HUD to begin processing eligible grant renewals under the two-year NOFO. It is important to note that this order does not require HUD to award or obligate funds at this time.
