On August 7th, the US District Court of Rhode Island issued a Summary Judgment in the two law suits against HUD regarding the FY 2026 Continuum of Care (CoC) Notice of Funding Opportunity (NOFO).
The Summary Judgment vacates the current NOFO, preventing it from moving forward. The full memorandum and order can be found HERE.
According to the order:
- “The Court’s review of the record and the parties’ arguments reveal that the issuance of the 2026 NOFO violates the APA [Administrative Procedures Act] based on HUD’s failure to engage in the notice-and-comment process required by the MVA [McKinney-Vento Homeless Assistance Act].”
- “The Court therefore sets aside HUD’s issuance of the 2026 NOFO in its entirety as violative of the APA.”
This order represents a final decision on the merits from the Court in these lawsuits, though HUD could still appeal the decision to a higher court. The Network is still reviewing the order and will be in touch with any further information and analysis.
